Lease Point B.V. ("Lease Point", "we", "us" or "our") is committed to protecting your personal data. This privacy policy explains what personal data we collect, why we collect it, how long we retain it, who we share it with and what rights you have.

This policy applies to visitors to our websites, prospective customers, customers and other business contacts. For the processing activities described in this policy, we act as the data controller under the General Data Protection Regulation (GDPR). This means that we determine which personal data is processed, for what purposes and how.

3. What personal data do we process?

We process personal data relating to prospective customers, customers and other business contacts, including their representatives, as well as visitors to our website.

We obtain this data:

  • Directly from you, for example through a contact form or quote request form, or by telephone, email or WhatsApp.

  • From third parties, such as leasing companies, lenders or insurers, in connection with your application.

  • From public sources, such as the Dutch Chamber of Commerce Business Register.

Depending on your relationship with us, this may include:

  • Basic information, such as your first and last name.

  • Contact and business details, such as your email address, telephone number, address, company name, job title and Chamber of Commerce number.

  • Details of the asset you wish to lease, such as your preferred vehicle.

  • Financial information required by a leasing company, lender or insurer to prepare a quote or assess your application, such as income or turnover figures and your IBAN.

  • Communications relating to your application, whether by email, WhatsApp or telephone.

  • Information about your use of our website, such as your IP address, device and browser information, and cookie data.

  • Any other personal data you provide, or that we receive about you, for the purposes described below.

We do not necessarily process all of the data listed above. This depends on your relationship with us, the service you request and, where applicable, the consent you have given.

4. Why do we process your personal data?

Arranging and advising on lease, financing and insurance agreements

We use your data to assess your application, prepare a suitable quote and provide advice. Where necessary, we share your data with the leasing company, lender or insurer offering the agreement.

Customer relationship management and administration

We use your data to manage our relationship with you, maintain customer records and handle invoicing.

Marketing and customer acquisition

We use your data to send newsletters and offers through Klaviyo and to display relevant advertisements through Google Ads and Meta Ads.

Website analysis and improvement

We use your data to analyse and improve the functionality and content of our website.

Customer communications

We use your data to respond to enquiries received through our contact form, email, telephone or WhatsApp, and to handle complaints.

Reviews

We use your data to collect and display customer reviews through Trustpilot.

Compliance with legal obligations

We use your data to meet legal obligations, such as maintaining business records and providing information to the Dutch Tax Administration or regulatory authorities. This may also include obligations arising from regulatory legislation applicable to our intermediary activities.

5. What are our legal bases for processing your personal data?

We process your personal data on one or more of the following legal bases under Article 6 of the GDPR:

  • Performance of a contract: to perform a contract with you or take steps before entering into a contract, such as preparing a quote.

  • Legitimate interests: for example, to improve our services and website or maintain our relationship with you.

  • Consent: for example, for newsletters and marketing cookies.

  • Compliance with a legal obligation.

6. Who do we share your personal data with?

Leasing companies, lenders and insurers

Lease Point B.V. acts as a broker or intermediary. We do not provide credit ourselves. To obtain a quote or arrange a lease, financing or insurance agreement, we share the necessary data with the relevant leasing company, lender or insurer, including our insurance partner, JW Verzekeringen.

These parties act as independent data controllers for their processing activities and have their own privacy policies.

Service providers acting as data processors on our behalf

We have entered into data processing agreements with the providers below where required by the GDPR. They process personal data only on our instructions.

  • Google Workspace (Gmail)

  • WhatsApp Business
    Communicating with leads and customers about their applications.

  • Klaviyo
    Sending marketing emails and newsletters.

  • Google Ads
    Advertising and measuring campaign performance.

  • Meta (Instagram/Facebook) Ads
    Advertising and measuring campaign performance.

  • Trustpilot
    Collecting and publishing customer reviews.

Public authorities and regulators

We may share your data with bodies such as the Dutch Tax Administration, regulatory authorities and law enforcement agencies where we are legally required to do so.

External advisers

We may share your data with accountants or legal advisers where necessary.

We never sell your personal data to third parties. We only share it with trusted parties, subject to appropriate safeguards.

7. Transfers outside the European Economic Area

Some of our service providers, including Google, Meta and WhatsApp, may process personal data on servers outside the European Economic Area (EEA), including in the United States.

Where this happens, we ensure that the transfer is covered by an appropriate level of protection, for example through:

  • An adequacy decision adopted by the European Commission, including the EU–US Data Privacy Framework where the relevant provider participates in that framework.

  • The European Commission's Standard Contractual Clauses (SCCs).

8. Cookies and similar technologies

We use cookies and similar technologies on our website:

  • Functional and strictly necessary cookies: required for the technical operation of the website. These cookies do not require your consent.

  • Analytics cookies: used to measure and improve how our website is used.

  • Marketing and tracking cookies: provided by Google Ads and Meta (Facebook/Instagram Pixel), allowing us to display advertisements and measure their effectiveness, including on other websites. We only place these cookies with your prior consent.

When you first visit our website, our cookie banner asks for your consent to non-essential cookies. You can withdraw or change your consent at any time through the cookie settings on our website or through your browser settings.

9. How long do we retain your personal data?

We retain your personal data only for as long as necessary for the purposes for which it was collected, in accordance with the GDPR and statutory retention requirements:

  • Customer data and case files relating to lease, financing and insurance agreements: for the duration of the agreement and subsequently for the applicable statutory tax retention period, which is generally seven years in the Netherlands.

  • Data relating to prospective customers who do not become customers: for a maximum of two years after our last contact, unless you request deletion sooner.

  • Newsletter and marketing data: until you unsubscribe or object to the processing.

  • Cookie data: for the retention periods specified for each cookie in our cookie banner.

If we wish to retain data for longer for historical, statistical or research purposes, we anonymise it.

10. Security

Lease Point takes appropriate technical and organisational measures to protect your personal data against loss, misuse, unauthorised access, disclosure and alteration. These measures include:

  • Secure, encrypted connections on our website.

  • Access controls for the systems in which we process personal data.

  • Data processing agreements with service providers that process personal data on our behalf.

  • Restricting access to personal data to employees who need it to carry out their work.

11. Your rights

Under the GDPR, you have the following rights:

  • Right of access: to access the personal data we process about you.

  • Right to rectification: to have inaccurate or incomplete personal data corrected.

  • Right to erasure (the "right to be forgotten"): to have your personal data deleted, provided we no longer need it and are not legally required to retain it.

  • Right to restriction of processing: to request that we restrict the processing of your personal data.

  • Right to data portability: to receive and transfer your personal data.

  • Right to object: to object to processing based on legitimate interests, including direct marketing.

  • Right to withdraw consent: to withdraw your consent where processing is based on consent.

You can submit a request by emailing info@lease-point.nl. We will respond within the statutory time limit of one month. To prevent misuse, we may ask you to verify your identity.

13. Changes to this privacy policy

We may update this privacy policy from time to time. Any changes will be published on our website, together with the date of the latest update. We recommend checking this page regularly.
